KNUST To Hold Graduation Ceremony on Friday Despite Reported Court Injunction

Few hours after an Accra High court reportedly granted an injunction restricting management of the Kwame Nkrumah University of Science and Technology from holding an already rescheduled congregation for post graduate students, a message issued from the office of the University Registrar to all students who are due to graduate indicates that the ceremony will come off as planned on February 1 and 2, 2019.

“Dear Student, please be reminded that the Special Congregation is coming off on Friday 1st and Saturday 2nd Feb. 2019 as scheduled. Thank you,” the message stated.

Background

A High Court in Accra has been reported to have placed an injunction on the upcoming congregation of the Kwame Nkrumah University of Science and Technology (KNUST) slated for February 1 and 2, 2019.

According to the court, the injunction is valid for ten days after which the plaintiff may apply for renewal.

The court granted the injunction ex parte motion for injunction after perusing the affidavit of the plaintiff, Eric Amon Neequaye in support of the motion upon hearing the submission for the council of the plaitiff, Jonathan Sarblah.

The order sighted by TV3 indicated that the defendant in the case, which is KNUST and its affiliate, the African Institute of Sanitation and waste Management are by the order restrained from conducting its graduation and or convocation slated for February 1 and 2, 2019 without the inclusion and issuance of certificate to the plaintiff.

Council for the plaintiff, Jonathan Sarblah argues that the fundamental human right of his client has been trampled upon.

“He has also by his profession, lost lost the use of the certificate and as a civil engineer, this course would have given a further impetus to his career and if you’re an engineer and you have been alleged that you have undertaken a course in Urban planning and you don’t have a certificate to show, that means that you’re going to loose out of the Job market,” He expressed.

The plaintiff is a legitimate students of the African Institute of Sanitation and Waste Management affiliated to KNUST after fulfilling all requirement and enrolling in October 8, 2015.

He was admitted into a five month post graduate diploma in Urban Planning, Environmental Sanitation and Waste Management who was scheduled to graduate and receive certification in November 2017 according to an attestation letter handed him on August 29, 2017.

However, KNUST has failed, refused and neglected to graduate and certify the plaintiff for a programme that cost him GH¢25,000.

Even a letter dated January 16, 2019 from his lawyers to the school did not receive the needed attention.

“If you attest that he completed the course and has fulfilled all requirement, why would you not issue him with the certificate. So its a mandatory order compelling them to issue him with the certificate which is due him. And the other aspect is that, it is also restriction, in other words the school cannot cannot conduct convocations without his inclusion,” Council for the plaintiff explained.
