A law lecturer at the Ghana Institute of Management and Public Administration (GIMPA), Lawyer John Darko says the disqualification of some presidential hopefuls were in order since almost all of them displayed some bouts of dishonesty.
According to the lecturer, having sworn an affidavit to give truthful information on the nomination form they were filling it was incumbent on them to verify the authenticity of every bit of it.
Speaking in an interview with Kwabena Ampratwum, one of the finest morning show hosts in Ashanti on Otec 102.9 Fm, Lawyer Darko argued proper checks should have been done by these disgraced aspirants before the submission of the forms to the returning officer of the Electoral Commission.
The legal brain forcefully submitted that the law backed the Commissioner to disqualify each of the 13 unfortunate presidential hopefuls.
LEGAL REMEDY:
However, Lawyer Darko has profusely commended the disqualified aspirants for choosing to seek legal remedy than resorting to unconventional means to get their cases heard.
According to him, having cris-crossed the country it was normal for the disqualified aspirants to feel embittered and angry.
”It is gratifying to see the disqualified aspirants rather choose the courts to get their cases resolved than to pick sticks and stones to settle it”, the lecturer posited.
He noted the action of these disqualified aspirants would serve a great lesson to the larger society that despite your disagreement with any decision remedies availed at the courts.
CRIMINAL ASPECT:
On persons who gave two conflicting signatures and information for different aspirants, Lawyer Darko urged the Attorney General and the Police to speed up investigations into the matter.
According to him, once the EC has the details of those unscrupulous persons it will rather make prosecution easy.
”I am happy the Police and the Attorney General can get all these people who gave wrong information out since the details covering them would be made available by the EC to fast track the process”, Lawyer Darko stressed.
He prayed the lessons drawn for the wrong filling of documents would be well learnt to ensure the mess is not created again in the history of political parties in the country.
